NOTICE OF SEALED BID SALE OF CITY OF MOUNT AIRY OWNED PROPERTY The Board of Commissioners of the City of Mount Airy intend to dispose of certain real property owned by the City of Mount Airy. These 15 parcels are identified on Exhibit A, attached hereto (each a “Parcel” and collectively the “Property”). The Board of Commissioners finds that the City does not need or desire the use of this Property, and desires to declare it surplus as allowed by law. First, the City will attempt to dispose of the Parcels through the advertisement and sealed bid option allowed by North Carolina General Statute 160A-268. The Board of Commissioners may consider other options approved by the North Carolina General Statues for competitive bid disposal if a qualified bid is not received and deemed acceptable. Therefore, the City of Mount Airy Board of Commissioners resolve that: 1. The Board of Commissioners hereby declares each of those Parcels identified within Exhibit A, attached hereto, as surplus. The Board of Commissioners hereby authorizes the sale of the Property by advertisement and sealed bid consistent with the terms of this resolution. 3. The City of Mount Airy will accept sealed bids until 5:00pm. on September 2, 2022. Bids shall be delivered to the office of the City Clerk at 300 S. Main Street, Mount Airy, NC or mailed to the City Clerk at PO Box 70, Mount Airy, NC. Mailed bids will be considered upon delivery if postmarked on or before 5:00pm September 2, 2022. 4. At 2:00pm on September 6, 2022 all bids received shall be opened in public in the Council Chamber at City Hall (300 South Main Street) and the amount of each bid recorded. The record of bids shall be reported to the Board of Commissioners during their regular meeting on September 15, 2022. 5. The Board of Commissioners will determine the highest responsible bidder for each Parcel and will award a bid or reject any and all bids by the end of the Board’s regular meeting. Each bid will remain open and subject to acceptance until the Board of Commissioners takes formal action on such bid. 6. In order to be deemed a responsible bid, the bid must (1) be submitted timely; (2) identify the subject Parcel by its correct parcel identification number (PIN); and (3) be accompanied by a bid deposit of five percent (5%) of the amount of the bid. A bid deposit must be in the form of a valid personal check or cashier’s check. 7. Each Parcel will be sold by separate bid with no grouping of Parcels allowed (no block bids). 8. The deposit of the high bidder to whom the award is made will be held until sale of the Property is closed, which shall occur within thirty (30) days of acceptance. The high bidder shall be responsible for all closing costs, including the excise tax (revenue stamp), recording fees and prorated portion of the costs of advertising this sale. 9. If the bidder to whom the award is made fails to or refuses at any time to close the sale, the bid deposit will be forfeited to the City of Mount Airy. 10. The deposits of other bidders will be returned at the time the Board of Commissioners awards the bid to the applicable high bidder. 11. In order to be a responsible bid to be considered for the award of the bid by the Board of Commissioners, a bidder must be current on payment of all property taxes owed to the City of Mount Airy. 12. The Property is being sold subject to all easements, conditions, restrictions and matters of record. Each Parcel will be sold “AS IS, WHERE IS.” Neither the Board, nor the elected officials, employees or agents of the City make any representation or warranty relating to the title nor any physical, environmental, health or safety conditions existing in, on, at or relating to the property, and all responsibilities or liabilities arising out of or in any way relating to any such conditions expressly are disclaimed. 13. The Board reserves the right to withdraw any Parcel from sale at any time before a final high bid is accepted and the right to reject at any time each and every bid.
